GUIDELINES IN CASE OF SHORTAGE, NON-AVAILABILITY OR MISSING PAGES OF ACCOUNTABLE
AND NON-ACCOUNTABLE ELECTION FORMS AND SUPPLIES IN CONNECTION WITH THE
OCTOBER 25, 2010 BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS.

WHEREAS, in the past elections, there were reports from the field offices of the Commission that accountable forms and non-accountable forms and supplies are either not available, with shortages, or with missing pages;
WHEREAS, these circumstances may happen on or immediately before election day and, therefore, due to time constraints no longer possible to print and deliver said lacking/missing forms/supplies in time for use on election day;
NOW, THEREFORE, the Commission on Elections RESOLVED, as it hereby RESOLVES to issue the following guidelines in case of shortage, non-availability or missing pages of accountable and non-accountable election forms and supplies:
- OFFICIAL BALLOTS
- Before Election Day
- On Election Day
The Election Officer shall report, by fastest means available, the shortage or non-availability of official ballots to the Allocation Committee which shall determine the necessity of printing the required ballots. For this purpose, the Allocation Committee is authorized to determine the quantity requirements for printing. However, if printing is not necessary, it is authorized to instruct the city/municipal Treasurer and Election Officer concerned on the manner of re-allocating the official ballots.
The Election Officer shall report, by fastest means available, the shortage or non-availability of official ballots to the Commission and resort to the provision of Section 182 (Emergency Ballots) of the Omnibus Election Code.

(1) If either the election returns/tally board is not received or not available, the Election Officer shall report such fact to the Commission through the Allocation Committee.
If the election returns is not available, the BET concerned, shall proceed with the counting of votes after the close of voting using an improvised election returns. After the counting, all forms used shall be placed inside the corresponding envelope and placed inside the ballot box. The ballot box shall be locked and deposited with the Municipal/City Treasurer for custody and safekeeping.
When the BET has received the official election returns, and with prior notices to the candidates and citizen’s arm, the BET shall open the ballot box, retrieve the envelope containing the improvised election returns and the tally board, and accomplish the official election returns by transferring accurately therein the votes obtained by the candidates. The said board shall then proceed with the distribution of the copies of the election returns in accordance with Section 49 COMELEC Resolution No. 9030.
(2) In case of missing pages/copies of the election returns, the BET shall take measures to reproduce/photocopy such missing page/s. It shall take steps to ensure that a copy for the Barangay Board of Canvassers is complete by obtaining the missing pages/copies from the other copies of the election returns and reproduce/photocopy the same. All such photocopies shall be certified by all members of the Board and watchers, if available.
If the statement of votes by precinct (SOVP) is not available, the Election Officer shall report such fact to the Commission through the Allocation Committee.
In case of missing pages/copies of the SOVP, the Barangay Board of Canvassers (BBOC) concerned shall take measures to reproduce/print the SOVPs. All such photocopies shall be certified to by the BBOC concerned.
In the Metro Manila Area and whenever possible, all lacking or missing pages of all accountable forms shall be replaced.
All non-accountable forms and supplies may be reproduced/photocopied upon prior approval of the Provincial Election Supervisor concerned.
The Printing Committee is hereby authorized to cause the printing of the required ballots/election returns.
The Packing and Shipping Committee is hereby authorized to immediately pack and ship the lacking ballots/election returns through the fastest means possible and ensure that the same arrives at and received by their intended recipients on or before election day.
